തിരുവനന്തപുരം: അസാധാരണ നീക്കവുമായി പ്രതിപക്ഷ നേതാവ് വിഡി സതീശന്. 'പോറ്റിയെ കേറ്റിയെ' എന്ന പാരഡിഗാനത്തിന്റെ ലിങ്കുകള് സമൂഹമാധ്യമങ്ങളില് നിന്നും നീക്കം ചെയ്യണമെന്ന പൊലീസ് നിര്ദ്ദേശത്തിനെതിരെ പ്രതിപക്ഷ നേതാവ് ഫേസ്ബുക്ക് കമ്പനിയായ മെറ്റയ്ക്ക് കത്ത് നല്കി. കോടതിയുടെ നിര്ദ്ദേശം ഇല്ലാത്ത സാഹചര്യത്തില് ഈ ഗാനം നീക്കം ചെയ്യുന്നത് മൗലികാവകാശങ്ങളുടെ ലംഘനമാണെന്ന് കത്തില് ചൂണ്ടിക്കാട്ടി. ഇത്തരത്തില് പ്രതിപക്ഷ നേതാവ് കത്ത് നല്കുന്നത് അസാധാരണമാണ്. പാട്ടിന് അനുകൂലമായി ഉയരുന്ന വികാരം കണക്കിലെടുത്താണ് നടപടി. ഇതോടെ പോലീസ് കത്ത് നല്കിയാലും പാട്ട് മെറ്റ പിന്വലിക്കുമോ എന്നത് നിര്ണ്ണായകമായി.
ഗാനം നീക്കം ചെയ്യണമെന്ന് ആവശ്യപ്പെട്ട് കേരള പോലീസ് മെറ്റ (Meta) ഉള്പ്പെടെയുള്ള സോഷ്യല് മീഡിയ പ്ലാറ്റ്ഫോമുകളെ സമീപിച്ചതായുള്ള റിപ്പോര്ട്ടുകള് നിങ്ങളുടെ ശ്രദ്ധയില്പ്പെടുത്താനാണ് ഞാന് ഈ കത്തെഴുതുന്നത്. ഈ ഗാനം നിര്മ്മിച്ചതിനും പ്രചരിപ്പിച്ചതിനും എതിരെ തിരുവനന്തപുരം സൈബര് പോലീസ് കേസെടുത്തതായി മനസ്സിലാക്കുന്നു. എന്നിരുന്നാലും, ഈ ഉള്ളടക്കം (Content) നീക്കം ചെയ്യണമെന്ന് ആവശ്യപ്പെട്ട് ഇന്നുവരെ ഒരു കോടതി വിധിയോ നിയമപരമായ ഉത്തരവോ നിലവിലില്ല എന്നത് ശ്രദ്ധേയമാണ്. നിയമത്തിന്റെ വ്യക്തമായ ലംഘനം തെളിയിക്കപ്പെടാത്ത പക്ഷം ആവിഷ്കാര സ്വാതന്ത്ര്യത്തിനുള്ള അവകാശം തടയാനാവില്ലെന്ന് ഇന്ത്യന് സുപ്രീം കോടതി പലതവണ വ്യക്തമാക്കിയിട്ടുള്ളതാണ്. നിയമവാഴ്ച നിലനില്ക്കുന്ന ഒരു ജനാധിപത്യ സമൂഹത്തില്, പാരഡി അല്ലെങ്കില് പരിഹാസം (Satire) പോലുള്ള കലാപരമായ ആവിഷ്കാരങ്ങള്ക്കു മേല് നിയന്ത്രണം ഏര്പ്പെടുത്തുന്നത് കൃത്യമായ നിയമ നടപടികളിലൂടെ മാത്രമായിരിക്കണം. ആവിഷ്കാര സ്വാതന്ത്ര്യത്തിനുള്ള ഭരണഘടനാപരമായ അവകാശത്തിന്റെ പരിധിയില് വരുന്നവയാണ് പാരഡിയും പരിഹാസ രൂപേണയുള്ള കലാസൃഷ്ടികളും എന്ന് പ്രതിപക്ഷ നേതാവ് പറയുന്നു.
കോടതി ഉത്തരവില്ലാത്ത പക്ഷം, ഭരണപരമായോ പോലീസ് നല്കുന്നതോ ആയ അപേക്ഷകള് മാത്രം അടിസ്ഥാനമാക്കി ഉള്ളടക്കം നീക്കം ചെയ്യുന്നത് സെന്സര്ഷിപ്പിനും ആവിഷ്കാര സ്വാതന്ത്ര്യത്തെ തടയുന്നതിനും കാരണമാകും. ഇത്തരം നടപടികള് ആ ഉള്ളടക്കം നിര്മ്മിച്ചവര്ക്ക് നികത്താനാവാത്ത ദോഷം വരുത്തിവെക്കുകയും ചെയ്യും. ഈ സാഹചര്യത്തില്, ഒരു കോടതിയുടെ വ്യക്തമായ നിര്ദ്ദേശം ഉണ്ടാകാത്ത പക്ഷം അല്ലെങ്കില് ഈ ഉള്ളടക്കം മെറ്റയുടെ കമ്മ്യൂണിറ്റി മാനദണ്ഡങ്ങള്ക്ക് (Community Standards) വിരുദ്ധമാണെന്ന് സ്വതന്ത്രമായ പരിശോധനയിലൂടെ ബോധ്യപ്പെടാത്ത പക്ഷം, പ്രസ്തുത ഗാനത്തിന്റെ ലിങ്കുകള് നീക്കം ചെയ്യുന്നതില് നിന്നും മെറ്റ വിട്ടുനില്ക്കണമെന്ന് അഭ്യര്ത്ഥിക്കുന്നുവെന്ന് സതീശന് പറയുന്നു.

I write to bring to your attention on the reports indicating that the State Police of Kerala, Union of India, has approached social media platforms, including those operated by Meta, seeking the removal of links to a song titled 'Pottiye Kettiye', which has been circulated online in connection with the alleged gold theft at the Sabarimala Temple in Kerala.
It is understood that the Thiruvananthapuram Cyber Police, Kerala, has registered a case concerning the creation and circulation of the said song.
However, it is important to note that, as of date, there is no judicial verdict, court order, or statutory direction mandating the takedown of this content. The Supreme Court of India has consistently held that the right to freedom of speech and expression cannot be curtailed unless a clear and legally established violation of law is demonstrated.
In a democratic society governed by the rule of law, any restriction on speech-particularly artistic expressions such as parody or satire-must strictly adhere to due process. Parody and satire are well-recognised forms of expression protected under the constitutional guarantee of free speech, subject only to reasonable restrictions imposed through lawful and judicially sanctioned means.
Administrative or police requests, in the absence of a competent court order, should not form the basis for content removal, as such actions may amount to prior restraint and set an unhealthy precedent for censorship. Such measures would also risk causing irreparable harm to the creators of the content.
In these circumstances, I respectfully request Meta to refrain from removing or disabling access to links related to the said song unless and until a competent court of law issues a clear and specific directive to that effect, or unless, upon independent assessment, the content is found to be in clear violation of Meta's Community Standards.
